Cervieri Monsuarez defends Adidas trademark in Bolivia
Uruguayan law firm Cervieri Monsuarez has successfully defended sportswear manufacturer Adidas in three lawsuits in Bolivia to defend its distinctive ‘three stripes’ logo on its footwear and precent three local brands from registering their trademarks with a similar logo.
Bolivia’s intellectual property watchdog SENAPI ruled in favour of Adidas against three local brands which use similar three-stripe motifs in their footwear designs, denying them the right to register their trademarks.
SENAPI ruled that the three brands were imitating the Adidas logo, which could lead to confusion among consumers.
Signs whose use in commerce unduly affects a third party’s right cannot be registered as trademarks, particularly when they are identical or similar to a trademark previously applied for registration or registered by a third party, SENAPI ruled.
