White & Case successfully defends Altán Redes in Mexico telecoms lawsuit
White & Case has successfully defended Altán Redes in an injunction trial brought by Rivada Networks and Spectrum Frontier against the bid award that was issued by Mexico’s Ministry of Communications and Transportations (SCT) in 2016 for the $7 billion shared network project.
The project, which aims to introduce competition to Mexico’s telecommunications industry thorough an open access 700MHz network, is the biggest project of its kind in the country’s history.
The proceedings arose when Rivada’s bid for the project was disqualified from proceeding for not presenting the performance bond. The company filed a lawsuit and argued that such documentation was not a substantial part of the technical proposal and that the authorities of the SCT were bound to request a clarification thereof prior to the disqualification.
After nearly four years of trial, the Collegiate Tribunal issued a favorable final judgment whereby it decided to deny the injunction requested by Rivada Networks and Spectrum Frontier. The bid award is now irreversible.
