Abi-Ackel acts in action in which STJ decides in favor of air safety
Marco Túlio Dias (pictrued), partner and chief operating officer of Abi-Ackel Advogados, was involved in an important victory at the Superior Court of Justice (STJ).
The 4th Panel of the STJ, in a unanimous decision, upheld the Special Appeal filed on behalf of an airline, a client of the firm, establishing an important precedent for the national air transport sector by ruling that companies are not obliged to transport pets in the cabin of aircraft when the criteria of internal safety policies are not met.
The case in question involved a request to transport two pets in the cabin, outside the weight and size standards allowed, on the grounds that they were emotional support animals for one of their guardians and that, for this reason, the company’s safety standards should be relaxed. Although it also disagreed with the regulations of the National Civil Aviation Agency (ANAC), which stresses that this type of transportation is not compulsory, the Paraná Court of Justice accepted the claim.
This precedent provides greater legal certainty for airlines in the application of their policies and greater security for passengers, whose integrity will be preserved.
