Souto Correa advises LATAM on the public civil action
Souto Correa Advogados provided legal counsel to LATAM Airlines Brasil in the public civil action aimed to challenge the legality of charging for additional services, such as advance seat selection and premium boarding, and also sought to impose new rules regarding the placement of priority seats within the aircraft. The claim for collective moral damages was set at R$10 million.
In its defense, LATAM demonstrated that its practices comply with current aviation regulations and argued that the Fare Freedom Regime allows for differentiated pricing through optional services. This flexibility enables airfares to be tailored to each passenger’s preferences, offering more affordable options for those who choose not to include additional services.
The court dismissed all claims, ruling that there was no abuse or illegality in offering these optional services. It emphasized that the pricing model adopted by airlines—where passengers pay only for the services they choose—helps make air travel more accessible and contributes to its democratization in Brazil.
