Hernández & Cía. advises BTG Pactual on US$6.6m financing

Hernández & Cía. has represented Banco BTG Pactual – Cayman Branch on a medium-term financing transaction granted to Sesuveca del Perú.

The financed company, established in Peru, is engaged in the exploration, extraction, classification, and commercialization of anthracite coal in Salaverry, Trujillo, La Libertad department, since 2002. Additionally, it operates a facility in Paracas, Ica, where it conducts iron crushing and classification activities.

Totaling US$6.6 million, the financing is intended to support the company’s capital investments and expenditures, as well as to restructure its existing financial obligations. To secure the transaction, the company established a trust over certain real estate properties it owns, located in the district of Salaverry, Trujillo.

As part of the transaction, an exhaustive due diligence process was carried out to assess the company’s legal standing, operations, and the properties used as collateral. This comprehensive review included verification of environmental, operational, and sector-specific permits, as well as compliance with applicable legal and regulatory obligations and ongoing administrative proceedings.
