Martos e Espinace Advogados launches tax practice
Martos e Espinace Advogados has opened a new strategic tax law practice covering advisory work and tax litigation. The firm will apply to corporate tax disputes the experience it built in urgent, highly complex health law cases.
Eduardo Carvalho, the firm’s manager, will head the new area. He also serves as a judge on the Tribunal de Impostos e Taxas de São Paulo (TIT), the São Paulo Tax and Fee Court.
The firm’s existing practice covers cases in which time, strategy and technical knowledge are decisive. These include claims involving high-cost medicines and home care, as well as cases seeking coverage from health plans for people with Autism Spectrum Disorder (ASD). In these matters, access to justice must be structured in an agile, individualised way.
The new practice carries that approach into tax matters. Work begins with an individual analysis of each company, looking at its sector, its economic situation and, above all, the impact tax litigation may have on the business’s operations and financial capacity.
Martos e Espinace Advogados takes the view that tax litigation should not be treated solely as a matter of collection or judicial defence. In some scenarios, it can pose a real risk to a company’s continuity and financial sustainability.
