BSVV represents Club Andino Osorno in authorisation of project in Puyehue
Barros Silva Varela & Vigil has represented the Club Andino Osorno before the Executive Directorate of the Environmental Assessment Service (” Servicio de Evaluación Ambiental”, SEA) in the authorisation for the construction and operation of the project “Refugio de Montaña Antillanca”, located on private land in the Puyehue National Park.
All this was done through an administrative complaint procedure, by which it was requested to annul the unfavourable environmental qualification of the Environmental Assessment Commission of Los Lagos.
In this regard, by resolution of 6 July of this year, the Executive Directorate of the SEA accepted in all its parts the administrative complaint presented, and determined that the unfavourable environmental qualification resolution should be amended, authorising the construction and operation of the project, as it (i) is compatible with the Washington Convention and with the Puyehue National Park Management Plan; (ii) complies with the legal requirements to be granted the sectoral environmental permit of Article 160 of the Environmental Impact Assessment System Regulations, and (iii) the hypotheses established in Article 11 letters c) and d) of Law N°19. 300, related to the susceptibility of affecting indigenous communities and the Puyehue National Park.
