Cervieri Monsuárez defends Baukus trademark in Paraguay
Law firm Cervieri Monsuárez has successfully defended German company Waelzholz Brasmetal on its filing for registration of its Baukus trademark in Paraguay.
Waelzholz Brasmetal had attempted to register the Baukus trademark of cold-rolled and heat-treated steel strips and profiles before Paraguay’s National Intellectual Property Office but had been blocked from doing so by the registration of a Baukus brand of rolled steel registered by a competitor.
However, the country’s Intellectual Property Office ruled that Waelzholz Brasmetal’s Baukus brand is renowned worldwide, with the Brazilian subsidiary of the company having operated in Brazil since 1973 and distributing to various countries in Latin America.
With the Baukus trademark already positioned in the market, the attempt to register a similar trademark was an attempt to confuse consumers, according to the ruling.
