Guerrero Olivos brokers loan for Peru’s Molitalia
Guerrero Olivos has represented food producer Molitalia, the Peruvian arm of Empresas Carozzi, in a $20 million financing granted by BCI, Miami branch, in its equivalent in Peruvian soles.
The law firm’s banking and finance and capital markets teams were in charge of the whole transaction, including the financing, collateral and the cross-currency swap agreement.
The transaction was complex as its stretched across three jurisdictions, Chile, Peru and New York, the law firm said, given that the credit agreement is governed by the laws of Peru, the collateral was granted under Chilean law, and the cross-currency swap agreement under the laws of the state of New York.
This meant that the law firm’s team had to work to make all the agreements compatible in order to achieve a successful closing of the transaction.
