Guerrero Olivos wins arbitration for Chilean football club

Guerrero Olivos advised Azul Azul on proceedings before FIFA and the Court of Arbitration for Sports.

Azul Azul is a public corporation, especially created to manage the assets of the professional football club Universidad de Chile for a minimum of a 30 year period.

Guerrero Olivos has regularly advised Azul Azul, handling its incorporation, private offering and then its IPO, and in the assets allocation process, during its insolvency status.

The FIFA arbitration proceedings started in 2014 when the club filed a claim to obtain payment from a Mexican football team, for the transfer of football player Isaac Diaz.

The first ruling rejected the claim, due that the Players’ Status Committee did not understood the link between Azul Azul and football team Universidad de Chile. The club filed an appeal before Court of Arbitration for Sports (CAS), based in Lausanne. After a long and complex written process and an oral hearing, the CAS, finally ruled to the benefit of Universidad de Chile, which is now entitled to receive full payment for the transfer of the football player. The arbitral ruling also established that the Mexican club has to pay interests, procedural costs and also other costs incurred for Universidad de Chile’s legal defense.

Partner Javier Ferrero led the Guerrero Olivos advising Azul Azul, working closely with Javier Ferrero, a partner at Spanish sports law boutique Senn Ferrero.
