PPU assists Nestlé in brand recognition against Café Manjar Celeste

Philippi Prietocarrizosa Ferrero DU & Uría Colombia has assisted SOCIÉTÉ DES PRODUITS NESTLÉ (Nestlé) in obtaining recognition of the notoriety of the trademarks NESCAFÉ (Mixed) and RED MUG (Figurative) in the opposition proceedings against the trademark CAFÉ MANJAR CELESTE (Mixed).

In the course of the proceedings, robust evidentiary material was presented that demonstrated the relevance and prestige of NESCAFÉ both in the Colombian market and in various countries around the world.

 The notoriety of the NESCAFÉ brand was accredited, highlighting not only its historical trajectory in the coffee industry, but also its unmistakable recognisability among consumers. The red cup icon, which accompanies the brand, is not only a symbol that resonates directly and immediately with the public, but has become a true emblem that reflects the very essence of the brand.

An essential element in this gain in notoriety was the strong evidence of the inseparable link between the red cup and the NESCAFÉ brand, a connection that transcends borders and markets, consolidating its status as a well-known brand. The recognition of this notoriety constitutes a real milestone in the protection of NESTLÉ’s trademark rights and its ability to exclude parasitic and/or similarly confusing uses of its NESCAFÉ and RED MUG trademarks.

This operation was completed on 24 October.
