PPU Peru advised Uber on Consumer complaint

Philippi Prietocarrizosa Ferrero DU & Uría assisted Uber Peru S.A. in a sanctioning procedure before the Specialized Chamber for the Defense of Competition of INDECOPI, linked to a complaint about acts of unfair competition.
The procedure concluded through Resolution 84-2020/SDC-INDECOPI after the Chamber declared the impropriety of the complaint against Uber Perú, recognizing that the company was not the administrator of the service objected to. Likewise, the authority determined that the Uber application is a technological platform that provides an intermediary service between drivers and passengers, which is not subsumed within the regulatory framework of the taxi service. On this point, it declared the complaint against Uber B.V. unfounded.
