SouzaOkawa advises Águas do Sertão on concession contract
SouzaOkawa Advogados advised on the discussions regarding the rebalancing of the water and sanitation concession agreement operated by Águas do Sertão in the State of Alagoas. The renegotiation of the agreement is related to its’ amendment in order to include new investments and provide better services to local population.
The transaction value was worth BRL 500 million.
The services encompassed the discussions with the state attorney’s office and other local authorities regarding the water and sanitation concession, the review of the draft documents, providing the suggestions to the amendment, and the provision of legal opinions structuring and defending the most efficient approach for rebalancing the concession agreement, especially due to budgetary and taxation.
The rebalance is paramount to foster investments within the concession for water and sanitation, strengthening the commitment to deliver the services for all users. The concession agreement itself was structured through support provided by BNDES and by Federal Government, and it is considered an example out of the recent auctions within water and sanitation held in Brazil.
