Gómez-Pinzón acts in Fresenius acquisition by DaVita

Gómez-Pinzón Abogados acted as local counsel to DaVita in the Colombian part of the acquisition of Fresenius Medical Care’s health clinics and dialysis services business in Latin America.

The closing of the transaction in Colombia took place on 13 December 2024, after receiving antitrust approval from the competent authority, which was a complex process that lasted several months. The transaction also required consideration of various regulatory aspects of the healthcare industry, making it more complex.

DaVita Inc, a leading provider of renal care services, signed an agreement to expand its international operations in Brazil and Colombia, and its entry into Chile and Ecuador. The deal includes four acquisitions from Fresenius Medical Care for a total purchase price of $300 million.

This transaction together represents 154 dialysis clinics (38 of which are located in Colombia), more than 7,100 employees, more than 30,000 dialysis patients and recorded pro forma revenues of approximately 370 million euros in 2023.

The transaction is particularly significant because, upon completion, DaVita Inc. has become the largest provider of dialysis services in Latin America and the main expansion of its operation in Colombia.

Jeroen Holland, Darab Khan, Jyotsana Gupta, Daniela Rivera Diaz and Valentin Vega acted as in-house counsels to DaVita.
