Machado Meyer advises on EMAE privatization

Machado Meyer advised Estado de São Paulo and, in collaboration with Banco Genial, worked on structuring the privatization, directly engaging in the legal audit process of EMAE for valuation purposes, in the project modeling and in the preparation of auction documents, including the privatization notice and the company’s share purchase agreement.

The privatization process of EMAE has been authorized since its foundation in January 1998, under the provisions of Law No. 9,361/1996, which established the State Privatization Plan (PED). The project is part of the Investment Partnership Program (PPI-SP), aiming to expand investment, employment, socioeconomic, technological, environmental and industrial development opportunities in São Paulo.

The transaction value was BRL 1.040.000.000,00. The amount indicated represents the highest bid by Phoenix Fundo de Investimentos em Participações Multiestrategia.

Machado Meyer advised Estado de São Paulo and relied on lead partners (pictured from left to right) Luis Filipe Gentil Pedro, Jose R. Prado Jr., and Lucas Sant’Anna, as well as lawyers Leticia Sobrinho De Aguiar and Pedro Saullo.
