RAD acts in financial restructuring of Acceso Crediticio
Rebaza Alcázar & De las Casas has acted as counsel to Acceso Crediticio in the simple reorganisation and related agreements entered into in connection with a financial restructuring with 30 international financial creditors.
The simple reorganisation and related agreements were entered into pursuant to terms established under general agreements governed by the laws of the State of New York, United States of America and entered into in late July 2024, for the private restructuring of its financial debt with creditors in excess of USD $200 million.
The firm also provided advice on the Peruvian legal aspects during the review and negotiation of such agreements which established terms and conditions so that the creditors could decide in their best interest the mechanisms for the recovery of their claims.
Acceso Crediticio is a company incorporated under the laws of the Republic of Peru, which until the beginning of September 2023 was authorised by the Peruvian Superintendency of Banking, Insurance and AFP to operate as a company of the financial system not authorised to take deposits from the public, and which has been offering financial intermediation mainly for the financing of the acquisition of motor vehicles for private purposes and also for taxi use.
