Tauil & Chequer assists extinction of Techint’s debarment sanction
Tauil & Chequer Advogados associated with Mayer Brown advised Techint Engenharia e Construção in an administrative request to the Federal Court of Accounts (TCU) to consider the term for compliance with a sanction of debarment applied by the Federal Comptroller General (CGU) related to the same factual context of the penalty imposed by the Court itself.
The TCU then verified that the administrative proceedings of the CGU encompassed the same facts analyzed by the Court, related to the “Lava Jato” operation. We managed to convince the TCU to determine the extinction of the penalty, due to the period of the CGU sanction already served, and the administrative rehabilitation, also sponsored by our team.
The change in understanding signaled an important advance towards harmonization among distinct state agencies in the exercise of their respective persecutory powers.
