Mattos Filho and Pinheiro Neto advise on financing hydraulic crisis scenario

Mattos Filho advised CCEE in obtaining a financing from Banco do Brasil, Banco Bradesco, Banco Santander (Brasil), Itaú Unibanco, Banco Nacional de Desenvolvimento Econômico e Social – BNDES, Banco Citibank, Banco Votorantim, Banco Safra, Banco de Investimentos Credit Suisse (Brasil), Banco Sumitomo Mitsui Brasileiro, Banco Abc Brasil, Banco Bocom BBM, China Construction Bank (Brasil) Banco Múltiplo, Banco Alfa de Investimento – lenders that were advised by Pinheiro Neto Advogados.

The total amount of BRL 5,503,981,615.69, in the hydraulic crisis scenario, supported by a provisional measusre sanctioned by Brazil’s president (MP 950), which dealt with temporary emergency measures for the electricity sector to deal with the state of calamity, which was regulated by Decree nº 10.438 / 2022, which authorized CCEE to create and manage an account intended to receive resources to cover deficits or anticipate revenues, totally or partially, related to items related to  concessionaires and permit holders of public services of electricity distribution – the account was denominated “Escassez-Hídrica”.

The aforementioned decree also provided that it would be up to CCEE to contract the credit operations intended to cover the aforementioned deficits or anticipation of revenues. The credit arising from the financing shall be disbursed to the Escassez-Hídrica, which shall be managed by CCEE and transferred to the concessionaires and permit holders of electricity distribution.
