Pinheiro Neto act as deal counsel on Basf’s FIDC
Pinheiro Neto Advogados acted as deal counsel to the transaction that consisted in the structuring of the Fundo de Investimento em Direitos Creditórios Opea Agro Insumos, a receivables investment fund (FIDC), by means of which Basf assigns its portfolio of receivables arising from the sale and purchase of Basf products that fits the eligibility criteria provided for the FIDC´s bylaws, representing an innovative financing program and a valuable opportunity for the improvement of the Client’s business activities. The FIDC issued a total of BRL 420,000 quotas, with a total offering amount of BRL 420 million.
It was Basf’s first FIDC, consisting of an innovative form of investment for the company. It is also important to note that the company already has an extensive background with securitization structures, however this was the first FIDC used by Basf for the securitization of receivables, which constitutes a major milestone in Basf´s transactions.
